2. Upon Receipt of a Valid Notice
Once a valid DMCA notice is received:
- We will remove or disable access to the allegedly infringing material.
- We will notify the contributor or user responsible for posting it.
- That user may then file a counter-notification if they believe the material was removed in error or qualifies as fair use.
3. Counter-Notification Procedure
If you are the content owner or author and believe your material was removed in error:
- You may file a counter-notification under 17 U.S.C. §512(g)(3).
- Your counter-notification must include:
- Identification of the material removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good faith belief the removal was a mistake or misidentification.
- Your name, address, phone number, and consent to the jurisdiction of the U.S. Federal District Court for your district.
- Your physical or electronic signature.
- Upon receiving a valid counter-notice, TheGWW.com will forward it to the original complainant.
- If the complainant does not file a lawsuit within 10 business days, the removed content may be restored.
4. Repeat Infringers
In compliance with the DMCA, TheGWW.com reserves the right to terminate accounts or contributor privileges of users who are repeat infringers.
